Resumo
O presente trabalho procurou estudar sobre o afeto e as suas mais variadas faces dentro direito
dando enfoque para o abandono afetivo, estelionato afetivo, adoção e filiação afetiva. Para
isso, é necessário entender a sua entrada na sociedade, compreendendo desde o poder
patriarcal até a sua evolução da família para os dias atuais. O afeto tornou-se a base das
relações familiares, sustentado pelos princípios da afetividade e da dignidade humana, sendo
que o rompimento desses pilares pode ocasionar em uma responsabilização civil. Dessa
forma, busca-se entender o abandono afetivo, através do dever dos pais para com a sua prole.
Enquanto o estelionato afetivo será analisado através das relações afetivas não reguladas pelo
direito. Já a adoção foi ponderada juntamente com o apadrinhamento afetivo demonstrando o
quanto o afeto é importante para formação de uma criança e como é protegida pelo
ordenamento jurídico essa relação. Por fim, foi abordado a filiação socioafetiva buscando
debater os provimentos aprovados pelo Conselho Nacional de Justiça acerca do tema.
The present study sought to study the affection and its most varied faces in law, focusing on affective abandonment, affective embezzlement, adoption and affective affiliation. On the other hand, adoption was considered together with affective sponsorship, demonstrating how important affection is for the formation of a child and how this relationship is protected by the legal system. Finally, socio-affective affiliation was discussed, seeking to discuss the provisions approved by the National Council of Justice on the subject.
