Resumo
As criptomoedas revolucionaram o mercado financeiro mundial e têm desafiado
constantemente as tradições bancárias e o status quo do cenário econômico global graças à
irreverência, à descentralização e à independência das moedas digitais. Nesse contexto, as
criptomoedas são uma proeminente ferramenta cambial e de operações cross-border, isto é,
um instrumento ideal de comércio transfronteiriço. Acontece, no entanto, que justamente em
virtude de sua natureza descentralizada e isenta de subjugação governamental, as
criptomoedas não possuem uma regulamentação normativa própria que discipline a sua
utilização, o que coloca em polvorosa o mercado financeiro global, notadamente o brasileiro,
escopo do presente trabalho. Destarte, esta pesquisa objetiva analisar o conceito e a natureza
das criptomoedas, bem como averiguar de que forma elas podem ser utilizadas como solução
cambial e operações cross-border e, por fim, discutir a insuficiência legislativa sobre as
moedas digitais no Brasil com foco nas incertezas e inseguranças jurídicas resultantes da sua
omissão regulatória.
Cryptocurrencies have revolutionized the world's financial market and have constantly challenged banking traditions and the status quo of the global economic landscape thanks to the irreverence, decentralization, and independence of digital currencies. In this context, cryptocurrencies are a prominent foreign exchange and cross-border trading tool, that is, an ideal instrument of cross-border trade. It turns out, however, that precisely because of their decentralized nature and exempt from government subjugation, cryptocurrencies do not have their own normative regulation that disciplines their use, which puts the global financial market, notably the Brazilian one, in an uproar, the scope of this work. Thus, this research aims to analyze the concept and nature of cryptocurrencies, as well as to ascertain how they can be used as a foreign exchange solution and cross-border operations and, finally, to discuss the legislative insufficiency on digital currencies in Brazil with a focus on the uncertainties and legal uncertainties resulting from their regulatory omission
