Abstract
O presente artigo científico visa analisar a utilização, no âmbito processual, do
conjunto probatório oriundo do encontro fortuito de provas e da fishing expedition no
decorrer de uma investigação criminal. Para tanto, fez-se necessário não apenas o
levantamento jurídico e bibliográfico quanto às definições de pescaria probatória e
serendipidade, bem como a importância da interação entre a epistemologia judiciária, a
prova penal e o respeito aos direitos e garantias constitucionais; mas também a pesquisa de
jurisprudências que trouxessem o entendimento do Superior Tribunal de Justiça acerca dos
institutos.
This article aims to analyze the possibility using, in the procedural scope, the body of evidence arising from the evidence and the fishing expedition during a criminal investigation. To this end, it was necessary not only to conduct a legal and bibliographic survey regarding the definitions of evidentiary fishing and serendipity, as well as the importance of proving the interaction between judicial and criminal epistemology and respect for constitutional rights and guarantees but also the research of investigations that would bring the Superior Court of Justice’s understanding of the institutes.
