Abstract
A pesquisa aborda a violação do direito autoral musical no contexto em que artistas
tiram vantagem uns dos outros de forma ofensiva, no contexto da lei, com foco nos benefícios
da aplicação da responsabilidade civil à luz da teoria da cegueira deliberada. O estudo visa
analisar as implicações legais e sociais desse cenário, considerando o ordenamento jurídico
brasileiro, com destaque para a Lei n. 9610/98 de Direitos Autorais. A pesquisa busca
compreender como a violação desses direitos afeta a vida dos artistas e qual o papel da
legislação na garantia de justiça e equidade nesse contexto. Ademais, a presente pesquisa
aborda de que forma a sociedade moderna corrobora para a ocorrência de cada vez mais
violações dos direitos autorais de uns artistas sobre os outros, mencionando a presença de
uma hipocrisia social subjacente e de que forma a irresponsabilização dos agentes violadores
que se defendem com base no estado de ignorância pode propiciar dificuldades pessoais e
profissionais para o artista ofendido.
The research addresses the violation of musical copyright in the context where artists take offensive advantage of each other within the framework of the law, with a focus on the benefits of applying civil liability in the light of the theory of willful blindness. The study aims to analyze the legal and social implications of this scenario, considering the Brazilian legal system, with an emphasis on Law No. 9610/98 on Copyright. The research seeks to understand how the violation of these rights affects the lives of artists and the role of legislation in ensuring justice and equity in this context. Furthermore, the present research examines how modern society contributes to an increasing occurrence of copyright violations among artists, mentioning the presence of underlying social hypocrisy, and how the absolution of violators who defend themselves based on a state of ignorance can lead to personal and professional difficulties for the offended artist.
