Abstract
O presente trabalho tem como objeto o estudo da possibilidade da utilização da Declaração de Regularização Cambial e Tributária (DERCAT) como elemento informativo para a instauração de Inquérito Policial. De início será exposto o contexto para a criação da Lei, além dos requisitos para a adesão ao programa de repatriação, as hipóteses de extinção da punibilidade e as causas de exclusão do contribuinte do Regime Especial de Regularização Cambial e Tributária (RERCT). Em seguida, serão analisado os conceitos de prova e elemento informativo para a classificação da natureza jurídica da DERCAT. Por fim, será realizada uma análise principiológica e legal a respeito da possibilidade da utilização da Declaração como elemento informativo para a instauração de inquérito policial.
The present work aims to study the possibility of using the Currency and Tax Regularization Declaration (DERCAT) as informative evidence for the initiation of a Police Investigation. Initially, the context for the creation of the law will be explained, as well as the requirements for joining the repatriation program, the hypotheses for the extinction of criminal liability, and the causes for the exclusion of the taxpayer from the Special Currency and Tax Regularization Regime (RERCT). Next, the concepts of evidence and informative element will be analyzed to classify the legal nature of the DERCAT. Finally, a principled and legal analysis will be carried out regarding the possibility of using the Declaration as informative evidence for the initiation of a police investigation.
