O limite dos poderes dos árbitros no combate às táticas de guerrilha no Brasil

Resumo
o presente artigo científico, desenvolvido por meio de revisão literária, visa promover
discussões a respeito das táticas de guerrilha no Brasil, principalmente acerca do limite dos
poderes dos árbitros no seu combate, ante a carência legislativa e de materiais bibliográficos.
Para isso, foi demonstrado que a arbitragem está consolidada no Brasil como uma forma de
resolução de disputas, o conceito de táticas de guerrilha e de que forma são utilizadas no
procedimento arbitral. Buscou-se avaliar, ainda, o cenário da utilização dessas táticas diante da
pandemia de Covid-19, em virtude da necessidade de adoção da condução digital do
procedimento. Além disso, foi apresentado que os árbitros possuem papel importante no
combate às táticas de guerrilha, em razão da sua função de conduzir o procedimento, sugerindose
a adoção diretrizes comprovadamente eficazes no âmbito internacional e um case
management competente. Em razão da ausência de previsão legal acerca das táticas de
guerrilha, a condenação em litigância de má-fé parece ser o caminho adequado para punir seus
usuários. Concluiu-se que o limite dos poderes dos árbitros dependerá de limites fixados pelas
partes e, na sua ausência, terão amplos poderes para decidirem sobre a punição adequada.
this scientific article, developed through a bibliographical review, aims to promote discussions about guerrilla tactics in Brazil, mainly about the limit of the arbitrators’ powers in their combat, given the lack of legislation and bibliographic materials. For this, it was demonstrated that arbitration is consolidated in Brazil as a form of dispute resolution, the concept of guerrilla tactics and how they are used in the arbitration procedure. The scenario for the use of these tactics in face of the Covid-19 pandemic was presented, due to the need to adopt the digital conduction of the procedure. In addition, it was shown that arbitrators have an important role in combating guerrilla tactics, due to their role in conducting the procedure, suggesting the adoption of proven effective guidelines at the international level and competent case management. Due to the lack of legal provision regarding guerrilla tactics, conviction in bad faith litigation seems to be the appropriate way to punish its users. It was concluded that the limit of the powers of the arbitrators will depend on limits set by the parties and, in their absence, they will have broad powers to rule on the appropriate punishment.
