Abstract
As estatísticas apresentadas pelo Conselho Nacional de Justiça demonstram a crise
no sistema judiciário brasileiro, sobretudo, na seara da execução. Nos tempos atuais, o acesso
à justiça é comumente associado ao uso exclusivo do sistema judicial para resolver conflitos,
no entanto, se estuda, cada vez mais, reformas capazes de agilizar e proporcionar uma efetiva e
célere tutela jurisdicional. O presente trabalho tem como objetivo analisar o fenômeno da
desjudicialização da execução civil como medida alternativa à crise do judiciário brasileiro.
Busca-se fazer um recorte sobre as reformas legislativas realizadas em Portugal e a atual
repartição de competências, com enfoque na figura do agente de execução. Nesse sentido,
também é examinado o Projeto de Lei nº 6.204/2019, o qual, inspirado em Portugal, propõe a
desjudicialização da execução de títulos executivos judiciais e extrajudiciais no Brasil.
The statistics presented by the National Council of Justice demonstrate the crisis in the Brazilian judicial system, especially around execution. Nowadays, access to justice is commonly associated with the exclusive use of the judicial system to solve conflicts, however, reforms capable of speeding up and providing effective and rapid judicial protection are increasingly being studied. This study aims at analyzing the phenomenon of de-judicialization of civil execution as an alternative measure to the Brazilian judicial crisis. It seeks to make an overview of the legislative reforms carried out in Portugal and the current division of powers, focusing on the figure of the enforcement agent. In this sense, it is also examined the Draft Law 6.204/2019, which, inspired in Portugal, proposes the de-judicialization of the execution of judicial and extrajudicial titles in Brazil.
