Abstract
Em 1º de abril de 2021 foi sancionada a Lei nº 14.133, nova Lei de Licitações e Contratos Administrativos, prevendo que o edital de licitação poderá contemplar matriz de alocação de riscos entre o contratante e o contratado, a ser posteriormente incorporada como clausula contratual para a aquisição de bens, contratação de serviços e execução de obras. Referida ferramenta solidifica importante evolução legislativa, possibilitando a alocação prévia de riscos e responsabilidades entre as partes, em termos de ônus financeiro decorrente de eventos supervenientes à contratação. O presente trabalho, então, tem como objetivo analisar a influência desse sistema de transferência de responsabilidade ex ante na precificação dos contratos administrativos, à luz da busca pela seleção da proposta mais vantajosa à Administração Pública.
Enacted on April 1, 2021, Law No. 14,133, which instituted the new Law on Bids and Administrative Contracts, provides that the bidding notice may include a risk allocation matrix between the contract parties, to be later incorporated as a clause contractual agreement for the acquisition of goods and contracting of services and works. The innovation solidifies an important legislative evolution, enabling the prior allocation of risks and responsibilities between the parties, in terms of financial burden resulting from events supervening to the contract. The present work, then, aims to analyze the influence of this ex ante responsibility transfer system in the pricing of administrative contracts, in the light of the search for the most advantageous proposal to the Public Administration.
