Abstract
O presente trabalho visa analisar a Lei n. 14.181/21, conhecida como lei do
superendividamento, partindo-se do exame do fenômeno do superendividamento na sociedade
brasileira e como a nova legislação pretende prevenir e tratar referido problema. Para tanto, fora
realizado estudo sobre o panorama da lei, os vetos e regulamentações supervenientes por parte
do Poder Executivo, além da sua efetividade no Tribunal der Justiça do Estado de São Paulo no
primeiro ano de vigência, podendo-se concluir sobre os efeitos até então alcançados e a
necessidade de medidas futuras.
This work aims to analyze Law no. 14.181/21, known as the law of overindebtedness, starting by examining the phenomenon of over-indebtedness in Brazilian society and how the new legislation intends to prevent and treat such problem. For this purpose, a study was conducted on the overview of the law, the vetoes and supervening regulations on the part of the Executive Branch, in addition to its effectiveness in the Court of Justice of the State of São Paulo in the first year it was in effect, with the possibility of concluding on the effects achieved so far and the need for future measures.
