Resumo
A ascensão do mercado de criptomoedas representa um grande rompimento com o modelo tradicional do sistema financeiro. Se, por um lado, criptoativos como a Bitcoin são sinônimos de inovação e avanço tecnológico, por outro, noções de anonimato, descentralização e ausência de regulamentação, quando relacionadas ao setor financeiro, representam insegurança jurídica. Nesse sentido, este artigo apresenta uma análise acerca dos desafios enfrentados, principalmente no que tange ao ordenamento jurídico brasileiro, para que haja uma regulamentação eficaz das operações realizadas com criptomoedas. Busca a realização de uma análise, portanto, acerca dos conflitos conceituais enfrentados pelos órgãos reguladores, as posições adotadas por ordenamentos jurídicos ao redor do mundo e os riscos inerentes a este sistema para, finalmente, evidenciar a principal pretensão legislativa em cenário nacional sobre a temática.
The rise of the cryptocurrency market represents a major break regarding the traditional model of the financial system. If on the one hand cryptocurrencies, such as Bitcoin, are synonymous of innovation and technological advancement, on the other hand, notions of anonymity, decentralization, and lack of regulation, when connected to the financial sector, may represent legal insecurity. In this sense, this article presents an analysis of the challenges faced, especially in terms of the Brazilian legal system, for the development of an effective regulation for cryptocurrencies transactions. Therefore, it will analyze the conceptual conflicts faced by regulatory agencies, the positions adopted by the law around the world and the risks inherent in this system, to finally highlight the main legislative intention regarding the national scene on the subject.
