Abstract
O presente artigo científico visa abordar a temática da falta de legislação e o que isso acarreta na situação do alimentante que após ter arcado com os alimentos em ação de alimentos gravídicos ingressados pela gestante, tem-se verificado após realização de exame de DNA a sua não paternidade, analisando esta temática conjuntamente com a Lei 11.804/08 que visa proteger principalmente a mãe e o nascituro, donos de direitos e expectativas de direitos. Aliado a isto, verificaremos as consequências da revogação do artigo 10 da citada lei para o ordenamento jurídico. O artigo também irá sopesar sobre quais os caminhos que tal alimentante poderá tomar para ter reparado os prejuízos sofridos em decorrência do pagamento de alimentos gravídicos, discorrendo sobre três grandes possibilidades amplamente discutidas pela doutrina: A indenização por danos materiais e morais; A ação de repetição de indébito contra o verdadeiro genitor e; A responsabilidade subjetiva da genitora e aferição de litigância de má-fé.
This scientific article aims to address the issue of lack of legislation and what this entails in the situation of the feeder who, after having paid for the food in action of pregnant foods entered by the pregnant, has been verified after carrying out a DNA test that her paternity, analyzing this theme together with Law 11.804/08, which aims to protect mainly the mother and the unborn child, owners of rights and expectations of rights. Allied to this, we will verify the consequences of the repeal of article 10 of the aforementioned law for the legal system. The article will also consider the paths that such a feeder can take to have repaired the damage suffered as a result of the payment of pregnancy food, discussing three great possibilities widely discussed by the doctrine: Compensation for material and moral damages; The action of repetition of undue payment against the true parent and; The subjective responsibility of the mother and measurement of bad faith litigation.
