Abstract
O Código de Processo Civil de 2015 trouxe de forma muito bem delineada em seu
texto o conceito do modelo cooperativo do processo, o qual incentiva os métodos de
autocomposição e traz mais empoderamento às partes. Dentro desse sistema cooperativo, o
Código ampliou a possibilidade de celebração de negócios jurídicos processuais atípicos. Dessa
maneira, o presente trabalho analisa a teoria e aplicação desse instituto, passando pelos
princípios que norteiam os negócios processuais, com ênfase no princípio da autonomia da
vontade, seus elementos de validade e eficácia e as suas limitações. A presente análise possui
as garantias e direitos fundamentais, pressupostos do sistema jurídico constitucional, como
meio e fim.
The 2015 Code of Civil Procedure has outlined in its text the concept of the cooperative model of the process, which encourages methods of self-composition and brings more empowerment to the parties. Within this cooperative system, the Code has extended the possibility of entering into atypical legal transactions. Thus, the present work analyzes the theory and application of this institute, passing through the principles that guide the procedural agreements, with emphasis on the principle of the parties’ independence and free will, elements of validity and effectiveness of the procedural conventions and its legal limitations. This analysis has the he guarantees and fundamental rights, as well as the whole constitutional legal system, as a means and as an end.
