O objetivo deste trabalho é analisar o sistema do Tribunal do Júri brasileiro. A inserção de
leigos na administração da justiça criminal tem sido uma prática adotada por diversos países
que consideram democrática a ideia de que os cidadãos sejam julgados por seus pares. No
Brasil, o veredicto é proferido por leigos, presididos por um juiz profissional.
Consequentemente, o Brasil optou por atribuir o julgamento de crimes dolosos contra a vida
ao Tribunal do Júri, com veredictos baseados na íntima convicção. A ausência de
fundamentação contraria o Estado democrático de Direito, por impossibilitar o controle da
adequação dos veredictos à lei. Além disso, há uma incompatibilidade com o artigo 93, inciso
IX, da Constituição Federal, que impõe a fundamentação das decisões judiciais. Portanto, com
base nesses elementos, entende-se que o Brasil deva alterar sua sistemática do Tribunal do
Júri.
The objective of this work is to analyze the Brazilian Jury System. The insertion of lay jurors in the administration of criminal justice has been a practice adopted by several countries that consider democratic for citizen to be judged by their peers. In Brazil, the verdict is declared by lay jurors, presided over by a professional judge. Consequently, Brazil has chosen to attribute the trial of intentional crimes against life to the Jury, with verdicts based upon personal conviction. The absence of reasoning contradicts the Democratic Rule of Law, for making it impossible to control the adequacy of the verdicts to the law. Besides that, there is an incompatibility with article 93, IX, of the Federal Constitution, which imposes the reasoning of judicial decisions. Therefore, based upon these elements, it is understood that Brazil should change its Jury Court System.
