Abstract
No presente trabalho abordaremos o tema do abandono afetivo a partir da ótica da responsabilidade civil, tratando a inobservância do dever de cuidar imposto pela Constituição Federal de 1988 aos genitores como ilícito civil passível de reparação. Traçaremos um panorama da evolução da família e a importância do afeto nesta relação, discutindo ainda a possibilidade de responsabilização de seus membros por danos morais causados dentro do núcleo familiar. Discutiremos os elementos da responsabilidade civil e suas implicações no abandono afetivo, bem como trataremos de aspectos processuais da ação de reparação por abandono afetivo. Por fim, será analisada criticamente a jurisprudência recente acerca do tema. Esta pesquisa se utilizou de uma pesquisa bibliográfica e jurisprudencial.
In this tesis we will address the issue of emotional abandonment from the perspective of civil liability, addressing the non-observance of the duty of care imposed by the Federal Constitution of 1988 to the parents as a civil offense subject to redress. We will draw an overview of the evolution of the family and the importance of affection in this relationship, and discuss the possibility of liability of their members for moral damages caused within the family nucleus. We will discuss the elements of liability and its implications for emotional abandonment, as well as address procedural aspects of remedial action for emotional abandonment. Finally, the recent jurisprudence on the subject will be critically analyzed. This research used a bibliographic and jurisprudential research.
