Abstract
O presente trabalho teve como escopo o estudo da união poliafetiva e a possibilidade de seu reconhecimento como entidade familiar no Direito brasileiro. A relação romântica e sexual entre três ou mais pessoas, simultaneamente e de forma consentida, é prática cada vez mais recorrente na sociedade pós-moderna, o que justifica a relevância da discussão jurídica sobre o tema, uma vez que o Direito deve acompanhar a evolução social. Mediante pesquisa bibliográfica, busca-se ponderar a necessidade de ampliação da proteção legal das famílias de modo a abarcar esse grupo, a despeito de perspectivas puramente morais e religiosas e por intermédio da desconstrução do paradigma da monogamia. Frente a este quadro, pretende-se examinar os reflexos práticos do reconhecimento jurídico desses núcleos familiares poliamorosos no sistema normativo pátrio, como os efeitos sucessórios e a multiparentalidade.
The present work had as scope the study of the polyaffective union and the possibility of its recognition as a family entity in Brazilian law. The romantic and sexual relationship between three or more people, simultaneously and with consent, is increasingly practiced in postmodern society, which justifies the relevance of the legal discussion on the subject, since the law must accompany social evolution. Through bibliographic research, we seek to consider the need to expand the legal protection of families to include this group, despite purely moral and religious perspectives and through the deconstruction of the monogamy paradigm. Against this background, it is intended to examine the practical consequences of the legal recognition of these polyamory family nuclei in the normative system of the country.
