Abstract
O presente trabalho tem como objetivo o estudo do direito imobiliário focado na transferência
do direito de construir e sua aplicabilidade, bem como as possibilidades para que a
transferência do direito ocorra. Portanto, o trabalho é divido em três capítulos: no primeiro
capitulo abordaremos a origem da transferência do direito de construir, bem como seu
conceito de acordo com o Estatuto da Cidade; no segundo capitulo observaremos o novo
tratamento do Plano Diretor de São Paulo e suas hipóteses, correlacionando com o Plano
Diretor Estratégico de São Paulo; e no terceiro capítulo observaremos todas as modalidades
para a realização da transferência do direito de construir e seus requisitos.
This study aims to study the real estate law focused on the transfer of the right to build and its applicability, as well as the possibilities for the transfer of the right to take place. Therefore, the work is divided into three chapters: in the first chapter we will address the origin of the transfer of the right to build, as well as its concept according to the City Statute; in the second chapter we will observe the new treatment of the São Paulo Master Plan and its hypotheses, correlating with the Strategic Master Plan of São Paulo; and in the third chapter we will observe all the modalities for the realization of the transfer of the right to build and its requirements.
