Lei Maria da Penha: a eficácia das medidas protetivas de urgência

A Lei n. 11.340/2006 foi criada com o objetivo de proteger as mulheres contra todas as formas
de violência doméstica e familiar. A partir da referida Lei, denominada Lei Maria da Penha,
foram criados mecanismos de coibição e prevenção de tal modalidade de violência, sendo
instituídas as chamadas medidas protetivas de urgência. Objetivou-se com o presente trabalho
um estudo aprofundado sobre a eficácia destes mecanismos, analisando-se criticamente a sua
utilização prática como instrumento de proteção às mulheres vítimas de violência doméstica. A
pesquisa partiu da contextualização histórica do avanço de direitos das mulheres até a criação
da Lei Maria da Penha. Por conseguinte, analisou-se a identificação e a abrangência do conceito
de violência doméstica e familiar, os sujeitos e as formas de tal tipo de violência. Por fim, a
pesquisa trouxe a conceituação das medidas protetivas de urgência, incluindo as recentes
alterações trazidas pela Lei n. 13.641/2018 e pela Lei n. 13.827/2019, de modo a buscar
entender se tais mecanismos mostram-se, ou não, suficientes no combate à violência de
doméstica e familiar no Brasil, propondo, ainda, sugestões para buscar maior eficácia prática
de tais medidas.
The Brazilian Law n. 11.340/2006 was created to protect women against all forms of domestic and family violence. From that Law, called Maria da Penha Law, mechanisms of restraint and prevention of this type of violence were created, and the so-called emergency protective measures were instituted. The aim of the present work was an in-depth study on the effectiveness of these mechanisms, critically analyzing their practical use as an instrument to protect women victims of domestic violence. The research started from the historical contextualization of the advance of women’s rights until the creation of the Maria da Penha Law. Therefore, the identification and scope of the concept of domestic and family violence, the subjects and forms of such violence were also analyzed. Finally, the research brought the concept of protective measures of urgency, including the recent changes brought by Law n. 11.641/2018 and Law n. 13.827/2019, in order to seek to understand if such mechanisms are or not sufficient in the fight against domestic and family violence in Brazil, also proposing suggestions to seek greater practical effectiveness of such measures.
