Abstract
O trabalho busca analisar a inserção da Emenda Constitucional 95/2016 na
Constituição Federal de 1988 (CF) e a sua interação com a política econômica constitucional e
com o projeto constitucional para a educação brasileira. A CF estabelece um projeto para o
desenvolvimento nacional e para a educação que se mostra, por vezes, contraditório. Assim, o
trabalho tem por fim observar como a Emenda contribui com esta contradição. Será verificada
como a Emenda Constitucional repercutirá na redução do valor dos investimentos públicos para
a educação nacional, como historicamente a ausência do Estado brasileiro no setor levou à
privatização do ensino, e como isto faz parte do projeto nacional contraditório proposto pela
Constituição.
This research aims to study the introduction of the Constitutional Amendment no. 95/2016 (EC 95/2016) in the Federal Constitution of 1988. It analyses the interactions between the Amendment, the economic policy proposed by the Constitution and the constitutional project for the Brazilian education. The Constitution establishes a project for the national development and the education which is contradictory under some circumstances. Therefore, the research will observe how the EC 95/2016 contributes to such contradiction. It will be demonstrated how its approval will result on a fall of the public investments for the educational sector; how, historically, the absence of the Brazilian State as a player in the sector has led to its privatization; and how this is part of the contradictory national project proposed by the Constitution.
