O Direito enfrenta atualmente casos de conflitos originados de Reprodução Humana Assistida,
e devido a falta de legislação sobre o assunto em território nacional, as pessoas que são
concebidas por essa técnica enfrentam dificuldades quando desejam saber a sua origem
biológica. Esse vínculo biológico não deve ser confundido com o vínculo criado com os pais,
aqueles que participaram do procedimento e conceberam a criança, já que o doador do material
genético não possui nenhuma obrigação com filho havido por essa técnica. Antes do
procedimento realmente iniciar, todos os participantes devem assinar um termo de
consentimento, concordando com as etapas e principalmente com o anonimato do doador de
gametas. No entanto, há o conflito entre o direito ao anonimato do doador e o direito do
concebido em saber a sua identidade genética, sua história. Devendo, portanto, verificar como
os outros países, que possuem legislação específica sobre essa técnica, versam sobre o assunto.
The Law currently faces cases of conflicts arising from Assisted Human Reproduction, and due to the lack of legislation on the matter in national territory, people who are conceived by this technique face difficulties when they wish to know their biological origin. This biological bond should not be confused with the bond created with the parents, those who participated in the procedure and conceived the child, since the donor of the genetic material has no obligation to the child that this technique has created. Before the procedure actually begins, all participants must sign a consent form, agreeing to the steps and especially agreeing to the anonymity of the gametes donor. However, there is a conflict between the right to anonymity and the right of the conceived one to know his genetic identity, his history. Therefore, I should check how other countries, which have specific legislation on this technique, deal with this issue.
