Resumo
O presente Trabalho de Conclusão de Curso (TCC) objetiva a discussão acerca da
constitucionalidade da imposição do regime da separação de bens aos sujeitos com idade igual
ou superior a setenta anos, obrigatoriedade essa estabelecida pelo artigo 1.641, inciso II do
Código Civil de 2002. O legislador ao criar esse dispositivo legal, vislumbrava a proteção do
idoso septuagenário de casamentos visando o interesse econômico de uma das partes. No
entanto, ao criar uma proteção legal para essas pessoas, retirou o direito delas de se
autodeterminarem e escolherem o próprio destino de seus bens patrimoniais. Nesse sentido,
para início dessa discussão, foi analisada a realidade da população brasileira, a qual grande
parte é idosa, tendo em vista o avanço da tecnologia e da medicina, o qual possibilita uma
maior e melhor qualidade de vida para as pessoas, possibilitando-se, assim, uma vida mais
longa e produtiva. Ademais, para aprofundar a discussão, foram estudados os institutos
jurídicos da personalidade jurídica e da capacidade civil, bem como as regras aplicáveis ao
instituto do casamento e ao regime de bens. Para finalizar a problemática trazida pelo presente
trabalho foram examinados os princípios constitucionais supostamente violados pela
exigência feita pelo artigo civilista, quais sejam: Princípio da Dignidade da Pessoa Humana,
Princípio da Liberdade e Princípio da Igualdade. Assim, o presente feito foi realizado
mediante pesquisas doutrinárias e jurisprudenciais, as quais concluem pela
inconstitucionalidade de mencionado dispositivo legal, uma vez que confrontam os citados
princípios constitucionais.
This Course Conclusion Paper (TCC) aims at discussing the constitutionality of the imposition of the property separation regime on subjects aged seventy or more, a requirement established by Article 1,641, item II of the 2002 Civil Code. The legislator, when creating this legal provision, envisioned the protection in their seventies or more from marriages aiming at the economic interest of one of the parties. However, by creating legal protection for these people, it deprived them of the right to self-determine and choose the very destination of their assets. In this sense, to start this discussion, the reality of the Brazilian population was analyzed, most of whom are elderly, advancement of technology and medicine advancement, which enables a greater and better quality of life for people, and consequently, a longer and more productive life. In addition, to further the discussion, the legal institutes of legal personality and civil capacity were studied, as well as the rules applicable to the marriage institute and the property regime. To conclude the problematic brought by the present work, the constitutional principles allegedly violated by the demand made by the civilist article were examined, namely: Principle of Dignity of the Human Person, Principle of Freedom and Principle of Equality. Thus, the present feat was accomplished through doctrinal and jurisprudential research, which conclude that the aforementioned legal provision is unconstitutional, since they confront the aforementioned constitutional principles.
