| dc.description.abstract | O presente estudo propõe-se, por meio de pesquisa bibliográfica, descritiva e quantitativa, a discorrer a respeito da relevância da regulação econômica e social do Estado brasileiro na Educação Superior Privada (ES Privada). Por critério metodológico, um recorte se fez necessário, em razão de a ES Privada ser responsável por 88% do total de matrículas do ensino superior do Estado e, especialmente, porque a Constituição Federal de 1988 (CF/88) assegura, em seus Artigos 174 e 209, a regulação do Estado na educação quando esta estiver sob a tutela da iniciativa privada. Esta regulação econômica, que também é social, tem como fim a tutela dos interesses do Estado que, por disposição constitucional, tem como propósito a educação de qualidade, o desenvolvimento do cidadão, o seu preparo para o exercício da cidadania e a sua qualificação para o trabalho. Em vista deste propósito, o Constituinte originário assegurou dispositivos regulatórios com potencial para resguardar a harmonia entre o serviço educacional prestado pela iniciativa privada e os valores constitucionais. Este potencial regulatório do Estado é instrumentalizado em duas esferas: por meio da autoridade concorrencial, o Conselho Administrativo de Desenvolvimento Econômico – Cade, ao qual cabe prevenir e reprimir as infrações vinculadas ao mercado educacional, e da autoridade reguladora, o Ministério da Educação – MEC, ao qual cabe regular as políticas nacionais de educação em sua integralidade. Deste modo, o presente estudo propõe-se a refletir a respeito da regulação do Estado na ES Privada e tem como eixo principal a análise do ordenamento regulatório ao qual a ES Privada está submetida, pois, mesmo que tenha o lucro como elemento basilar, deve garantir também os interesses socioeconômicos do Estado, mantendo o equilíbrio indispensável para que o propósito construtivo e transformador inerente ao serviço educacional seja uma realidade. | |

| local.description.abstracten | This study proposes, through bibliographic, descriptive and quantitative research, to discuss the relevance of the economic and social regulation of the Brazilian State in Private Higher Education (Private HE). For methodological reasons, a cut was necessary, since Private Higher Education is responsible for 88% of higher education enrollments in the State, especially because the Federal Constitution of 1988 (CF/88) ensures, in its Articles 174 and 209, the regulation of the State in education when it is under the tutelage of the private sector. This economic regulation, which is also social, aims to protect the interests of the State, which, according to constitutional provisions, is the purpose of quality education, the development of citizens, their preparation for the exercise of citizenship and their qualification for work. In view of this purpose, the original Constituent assured regulatory devices with the potential to safeguard harmony between the educational service provided by the private sector and constitutional values. This regulatory potential of the State is implemented in two spheres: through the competition authority, the Administrative Council for Economic Development – Cade, which is responsible for preventing and repressing infractions linked to the education market, and through the regulatory authority, the Ministry of Education – MEC, which is responsible for regulating national education policies in their entirety. Thus, this study aims to reflect on State regulation in Private Higher Education, whose main axis is the analysis of the regulatory order to which Private Higher Education is subject, since, even having profit as a fundamental element, it must also guarantee the socioeconomic interests of the State, maintaining the indispensable balance so that the constructive and transformative purpose, inherent to the educational service, becomes a reality. | |
