| dc.description.abstract | A Reforma Trabalhista (Lei nº 13.467/17) trouxe diversas alterações e inclusões em seu texto legislativo, dentre elas está a criação do trabalhador hipersuficiente por meio do artigo 444, parágrafo único, da CLT. O referido dispositivo autoriza que esse empregado estipule livremente suas cláusulas de trabalho com seu empregador no que se refere aos assuntos contidos no art. 611-A da CLT. Para que isso seja possível, deverá preencher dois requisitos: ter diploma de nível superior e perceber salário mensal igual ou superior a duas vezes o limite máximo dos benefícios do Regime Geral de Previdência Social. Nesse cenário, a partir do método dedutivo, com revisão bibliográfica, o presente trabalho de conclusão de curso analisará o surgimento dessa figura e as intenções contidas na sua elaboração, de forma a apontar se os princípios pertencentes ao Direito do Trabalho foram observados com a sua criação e vigência. Em seguida, serão analisadas as suas características que o diferencia do empregado hipossuficiente e do típico alto empregado. Na sequência, serão analisadas as implicações constitucionais dessa inclusão legislativa. Ao final, serão explanadas as perspectivas doutrinárias acerca do hipersuficiente, bem como possíveis meios de atenuar o impacto que essa figura pode trazer nas relações de trabalho. | pt_BR |
| dc.description.abstract | The Labor Reform (Law no. 13,467/17) brought several changes and inclusions in its legislative text, among them is the creation of the hypersufficient worker by means of article 444, single paragraph, of the CLT. The referred provision authorizes this employee to freely stipulate his/her work clauses with his/her employer regarding the matters contained in article 611-A, of the CLT. For this to be possible, he must fulfill two requirements: have a University Degree and receive a monthly salary equal to or higher than twice the maximum limit of the benefits of the General Social Welfare Regime. In this scenario, based on the deductive method, with bibliographic review, the present work of course conclusion will analyze the emergence of this figure and the intentions contained in its elaboration, in order to point out if the principles belonging to Labor Law were observed with its creation and validity Then, its characteristics will be analyzed, which differentiate it from the hypo-sufficient employee and the typical high employee. Next, the constitutional implications of this legislative inclusion will be analyzed. At the end, the doctrinaire perspectives about the hypersufficient will be explained, as well as possible means of mitigating the impact that this figure may bring on labor relations. | pt_BR |
