Abstract
Artigo direcionado a investigar a responsabilidade civil do estado por demora na prestação jurisdicional pelo método de pesquisa bibliográfica e jurisprudencial, estuda a função jurisdicional assim como seu elemento distintivo que seria a coisa julgada, passando a uma análise do histórico e teorias aplicadas à responsabilização estatal. Verifica a possibilidade de enquadramento da jurisdição como serviço público e do juiz como agente público e discute a incidência, ou não, do artigo 37 §6º da Constituição, assim como a possibilidade de inclusão de excessiva demora na prestação jurisdicional no conceito de erro judiciário, e a existência da modalidade omissiva deste.
This article aims at to investigate the civil liability of the state for delay in providing the jurisdiction by the method of bibliographic and jurisprudential research, studies the jurisdictional function as its distinctive element that res judicata, passing an analysis of the history and theories applied to state-owned accountability. Notes the possibility of framing the jurisdiction as a public service and the judge as a public agent, and discusses whether or not Article 37 §6 of the Constitution applies, as well as the possibility of including excessive delay in the provision of jurisdiction in the concept of judicial error, and the existence of its omissive modality.
