O presente estudo visa verificar eventuais limitações da utilização de softwares de
Inteligência Artificial em pesquisas, principalmente na área da saúde, causadas pelos princípios
da finalidade, necessidade e adequação da Lei nº 13.709, de 14 de agosto de 2018, conhecida
como Lei Geral de proteção de dados (LGPD). O objetivo é apurar se a regulamentação é
adequada de forma que não cause impasses para implantação de softwares na área da saúde,
que possibilitem, por meio do tratamento de dados, a descoberta de novos tratamentos, doenças
e diagnósticos, de forma mais rápida e assertiva. Dado seu caráter inovador, para verificar os
potenciais efeitos causados por ela, neste trabalho foi feita analogia com a regulamentação
europeia, General Data Protection Regulation. Além disso, utilizou-se de um caso concreto
para entender como a regulamentação poderia intervir na forma em que ocorre o tratamento de
dados.
The study aims to verify possible limitations of the use of Artificial Intelligence software, especially in health research, caused by the principles of purpose, necessity, and adequacy of the General Personal Data Protection Law (LGPD) No. 13,709, of August 14, 2018. The goal was to determine whether the regulation is adequate so as not to cause impasses for the implementation of software in the health area, which allow, through data processing, the discovery of new treatments, diseases, and diagnoses, in a faster and more assertive way. Because of the law was newly introduced in Brazil, in order to verify the potential effects caused by it, an analogy was made with the European regulation, with the General Data Protection Regulation, the law used as a parameter for the creation of the LGPD, and because of this LGPD reproduced some of its fundamentals. In addition, cases were verified in practice, to understand how the regulation could intervene in the way data processing occurs.
