Abstract
A presente pesquisa objetiva analisar a aplicação do sistema
patentário, especialmente na área da saúde, seus fundamentos de existência e
a necessidade de aplicação da função social à concessão de patentes, a fim de
garantir o prevalecimento do interesse público e das necessidades sociais. Para
tanto, enfatiza a falta de acesso da população às vacinas e demais insumos
médicos necessários para tratamento do COVID-19 e aborda que o instituto do
licenciamento compulsório no Brasil não é a solução mais eficaz para a
problemática em questão, uma vez que o país não possui um parque
tecnológico, infraestrutura, investimento governamental e know-how necessário
para a produção de vacinas imunizantes.
This research aims to analyze the application of the patent system, especially in the health area, its fundamentals of existence and the need to apply the social function to the granting of patents in order to ensure the prevalence of public interest and social needs. For this purpose, it emphasizes the lack of access of the population to vaccines and other medical supplies necessary for the treatment of COVID-19 and addresses that the institute of compulsory licensing in Brazil is not the most effective solution to the problem at issue, since the country does not have a technological park, infrastructure, government investment and know-how necessary to produce immunizing vaccines.
