O trabalho vincula-se à área do direito digital e utiliza o método de pesquisa exploratório para
elucidar a impunidade de quem comete crimes em jogos virtuais. A investigação conceitua os
jogos virtuais, especificamente, aqueles que possuem um modo cooperativo entre grupos de
pessoas. Esse tipo de jogo precisa da comunicação entre os jogadores para a vitória nas partidas.
Porém, dependendo da situação dentro do jogo, os jogadores desviam a finalidade da
comunicação com a equipe e adversários, para praticar crimes contra a honra, racismo e demais
crimes. Por esse motivo, o trabalho fez uma análise das estatísticas publicadas pela Riot Games,
em 2022, sobre as restrições de comunicação e banimentos feitos durante o ano de 2021 no jogo
Valorant. A partir dela foi possível concluir que as punições feitas são muito irrelevantes
comparado com o número total de jogadores. Além disso, com o resultado, o trabalho levanta a
discussão entre a colisão entre o direito fundamental a punição do racismo e a proteção dos dados
pessoais nos meios digitais, por exemplo. Consequentemente, esse embate gera a impunidade dos
agressores no âmbito virtual pela dificuldade de responsabilizá-los por seus atos. Desse modo, o
trabalho objetiva chamar a atenção dos poderes executivo, legislativo e judiciário a discutir esse
tema para concretizar os direitos dos cidadãos também em ambientes virtuais.
This study is linked to the area of digital law and uses exploratory research method to elucidate the impunity of those who commit crimes in virtual games. The investigation conceptualizes virtual games, specifically, those that have a cooperative mode between groups of people. This kind of game needs a communication between players to achieve the victory in matches. However, depending on the situation within the game, players deviate the purpose of communication with team and with the opponents to commit crimes against honor, racism, and other crimes. For this reason, the work had analyzed the statistics published by Riot Games in 2022 about communication restrictions and banishments during the year of 2021 in the Valorant game. Based on this, it was possible to conclude that the punishments are very insignificant compared to the total number of players. Additionally, with this result, the work raises the discussion of the collision between the fundamental right to punish racism and the protection of personal data in digital media, for example. Consequently, this clash generates the impunity of aggressors in the virtual ambit due to the difficulty of charge them for their actions. Thus, the objective of this work is to draw the attention of the executive, legislative, and judicial powers to discuss this issue in order to concretize the citizens’ rights also in virtual environments.
