Abstract
O presente artigo busca investigar quais foram as contribuições do Direito Internacional Humanitário para a tipificação dos crimes de guerra e de que maneira se deu este processo. Serão analisados aspectos históricos e jurídicos dos institutos da guerra, do Direito Internacional Humanitário, do Comitê Internacional da Cruz Vermelha e dos tribunais penais internacionais. Trata-se de uma pesquisa qualitativa, pois a pesquisa apreciará conceitos, fatos e dados concretos. Foi empregado o método dedutivo, através do estudo da doutrina e da jurisprudência internacional. Primeiramente, serão explorados e conceituados os institutos da guerra, o Direito Internacional Humanitário, o Comitê Internacional da Cruz Vermelha e os Crimes de Guerra. Em seguida, será desenhado um panorama histórico dos tribunais penais internacionais para demonstrar como o Direito Humanitário foi abordado em seus julgamentos. Por fim, será analisado o funcionamento atual do Tribunal Penal Internacional e realizada uma análise jurisprudencial para que se demonstre como o Direito Humanitário é visto e aplicado na atualidade.
This article seeks to investigate the contributions of International Humanitarian Law to the classification of war crimes and how this process took place. Historical and legal aspects of the institutes of war, International Humanitarian Law, the International Committee of the Red Cross and international criminal courts will be analyzed. This is a qualitative research, as the research will assess concepts, facts and concrete data. The deductive method was used, through the study of doctrine and international jurisprudence. Firstly, the institutes of war, International Humanitarian Law, the International Committee of the Red Cross and War Crimes will be explored and conceptualized. Next, a historical overview of international criminal courts will be drawn to demonstrate how Humanitarian Law was approached in their trials. Finally, the current functioning of the International Criminal Court will be analyzed and a jurisprudential analysis will be carried out to demonstrate how Humanitarian Law is seen and applied today.
