dc.description.abstractA presente dissertação se propõe a identificar se a Justiça Eleitoral possui competência para processar e julgar crime de violência política contra a mulher, art. 326-B inserido no Código Eleitoral pela Lei nº 14.192/2021, de modo que foi delimitado como objeto de estudo os casos em que o delito ocorre contra a detentora do mandato eletivo, que não é candidata, com a finalidade de impedir ou dificultar o desempenho do seu mandato eletivo. Inicia-se a análise a partir do entendimento de que o bem jurídico penal protegido pela Justiça Eleitoral se vincula à legitimidade das eleições, ao livre exercício do voto e aos serviços eleitorais, e não à bem jurídicos afetos ao exercício do mandato. Estrutura-se a pesquisa em três capítulos. O primeiro capítulo traçará um panorama histórico e jurídico dos crimes eleitorais no Brasil, abordando sua natureza jurídica, classificação e os bens jurídicos tutelados delineando um panorama sobre quais são os bens jurídicos penais eleitorais. O segundo capítulo examinará os critérios de definição de competência jurisdicional, com ênfase na delimitação entre a Justiça Eleitoral e outras esferas do Judiciário. O terceiro capítulo detalhará o que diz respeito à violência política contra a mulher e analisará, de forma específica, o art. 326-B do Código Eleitoral, a partir da interpretação textual, sistemática e teleológica da norma, identificando-se, por fim, a incompetência da Justiça Eleitoral para processar e julgar crime de violência política contra a mulher quando a vítima for detentora de mandato eletivo, sem ser, entretanto, candidata. Ao final, a pesquisa apresentará a análise detalhada de decisões recentes dos Tribunais Regionais Eleitorais e do Tribunal Superior Eleitoral, com o intuito de identificar o atual posicionamento dos Tribunais.

local.description.abstractenThis dissertation aims to determine whether the Electoral Court has jurisdiction to prosecute and adjudicate the crime of political violence against women, as defined in Article 326-B of the Electoral Code, introduced by Law No. 14.192/2021. The scope of the study is limited to cases where the offense is committed against an elected officeholder who is not a candidate, with the intent to hinder or obstruct the performance of her electoral mandate. The analysis begins with the premise that the legal interests protected under electoral criminal law are intrinsically linked to the legitimacy of elections, the free exercise of voting rights, and the integrity of electoral services, rather than to legal interests associated with the exercise of the mandate itself. The research is structured into three chapters. The first chapter provides a historical and legal overview of electoral crimes in Brazil, examining their legal nature, classification, and the protected legal interests, outlining the core electoral legal interests safeguarded by criminal law. The second chapter explores the criteria for defining jurisdictional competence, with an emphasis on distinguishing the jurisdiction of the Electoral Court from other branches of the Judiciary. The third chapter focuses on political violence against women, specifically analyzing Article 326-B of the Electoral Code through textual, systematic, and teleological interpretations. lt concludes by identifying the Electoral Court's lack of jurisdiction to prosecute and adjudicate political violence crimes against women when the victim is an elected officeholder but is neither a candidate. Finally, the research presents a detailed analysis of recent decisions from Regional Electoral Courts and the Superior Electoral Court, aiming to identify the prevailing judicial stance on this matter.
