A busca pelo padrão estético sempre esteve presente no subconsciente do coletivo e
atualmente essa obsessão está sendo fomentada como nunca tendo em vista o alcance das
redes sociais. Dessa forma, a demanda por procedimentos de cunho meramente estético está
cada vez maior e, consequentemente, a especialidade médica de cirurgia plástica também se
encontra em uma constante crescente. Diante disso, são incontáveis os casos em que tais
procedimentos não obtiveram êxito e o paciente sofreu diversos danos. Nesse viés, o presente
trabalho tem o objetivo de esclarecer o conceito de responsabilidade civil e os parâmetros que
a prestação do serviço médico deve seguir. Assim, foi explicitada a natureza da
responsabilidade civil do cirurgião plástico, o conceito de dano estético e como ele deve ser
avaliado, quais as excludentes da responsabilidade médica e as maneiras que a vítima pode ser
compensada. Nesse viés, evidenciou-se que o médico assume obrigação de resultado em
procedimentos meramente estéticos e a natureza de sua responsabilidade civil é subjetiva com
presunção de culpa, isto é, cabe aos cirurgiões plásticos demonstrarem que sua conduta
respeitou os parâmetros médicos e não possui relação com o resultado danoso.
Social networks are fostering the obsession with aesthetic standards because they have always been present in the collective subconscious. Thus, the demand for merely aesthetic procedures is constantly increasing and, consequently, the medical specialty of plastic surgery is also constantly growing. Therefore, there are countless cases in which such procedures are not successful, and the patient suffers several damages. In this vein, this paper aims to clarify the concept of civil liability and the parameters that the provision of medical services must follow. Thus, the nature of the civil responsibility of the plastic surgeon, the concept of esthetic damage, and how it should be evaluated, which are the exclusions of medical responsibility and the ways that the victim can be compensated were explained. In this bias, it was evidenced that the doctor assumes an obligation as to result in merely aesthetic procedures and the nature of his civil liability is subjective with presumption of guilt, that is, it is up to the plastic surgeons to demonstrate that their conduct respected the medical parameters and has no relationship with the harmful result.
