Resumo
Este artigo tem como escopo o estudo do fenômeno dos precedentes vinculantes, inovação trazida pelo Código de Processo Civil de 2015 (“CPC/15”), e a análise detalhada de cada uma das hipóteses previstas no art. 927 da lei processual. Primeiramente, discorrer-se-á sobre o fenômeno dos precedentes judiciais durante a vigência do Código de Processo Civil de 1973 (“CPC/73”) que, embora não dotados da expressiva magnitude que veio a ser trazida apenas com a promulgação do CPC/15, eram dotados de um certo caráter vinculante, que será objeto de estudo. Em seguida, será tratada a inovação trazida pelo CPC/15 e como o fenômeno dos precedentes passou a ocupar uma posição mais concreta no Direito brasileiro. Ato contínuo, serão analisadas as hipóteses de formação dos precedentes vinculantes trazidas pelo art. 927 do CPC e suas aplicabilidades. Por fim, os temas abordados ao longo do artigo serão repassados de forma a consolidar o cenário geral dos precedentes e expor a conclusão obtida através do presente estudo.
This article aims to study the phenomenon of binding precedents, an innovation brought by the Civil Procedure Code of 2015 ("CPC/15"), and the detailed analysis of each of the hypotheses provided for in the art. 927 of the procedural law. First, we will discuss the phenomenon of judicial precedents during the validity of the Code of Civil Procedure of 1973 ("CPC/73") which, although not endowed with the expressive magnitude that was only brought with the enactment of the CPC/15, were endowed with a certain binding character, which will be the object of study. Next, the innovation brought by CPC/15 will be addressed, as how the phenomenon of precedents came to occupy a more concrete position in Brazilian law. Next, the hypotheses for the formation of binding precedents brought by art. 927 of the CPC and their applicability will be analyzed. Finally, the topics discussed throughout the article will be reviewed in order to consolidate the general scenario of precedents and present the conclusion obtained through this study.
