Com o avanço da tecnologia nos dias atuais, comumente as pessoas têm perfis em
redes sociais. Contudo, com o aumento de usuários nas plataformas e a vontade de exposição
do seu dia a dia, facilmente são encontrados perfis compartilhando imagens excessivas de
crianças e adolescentes, seja em aqueles usuários criados em nome dos menores ou atrelados
aos dos pais. Dessa forma, uma vez que está cada dia mais comum o compartilhamento de
imagens de crianças e adolescentes, questiona-se a violação dos seus direitos
constitucionalmente garantidos no tocante à privacidade e proteção de seus dados e as suas
eventuais consequências. Assim, o presente artigo cientifico, utilizando-se da pesquisa
bibliográfica, legislativa e jurisprudencial, visou analisar a possibilidade do Instagram de ser
responsabilizado na esfera civil de eventuais danos causados a menores de idade em razão do
overshareting, bem como se a plataforma tem o dever de observar as publicações
compartilhadas em seus veículos. No final do presente artigo, concluiu-se que atualmente o
ordenamento jurídico brasileiro isenta o provedor de internet de responsabilidade por postagem
feitas por terceiros, de modo que o Instagram não pode ser responsabilizado de danos
decorrentes de overshareting.
With the advancement of technology nowadays, people commonly have profiles on social midia. However, with the increase in users on the platforms and the desire to expose their daily lives, profiles can easily be found sharing excessive images of children and teenagers, whether created in the name of minors or linked to parental users. Therefore, since the sharing of images of children and adolescents is becoming more common every day, the violation of their constitutionally guaranteed rights regarding privacy and protection of their data and its possible consequences are being questioned. Therefore, this scientific article, based on bibliographic, legislative, and jurisprudential research, analyzed the possibility of Instagram being held civilly liable for any damages caused to minors due to oversharing, as well as whether the platform has a duty to monitor the publications shared on its platform. At the end of this article, it was concluded that the Brazilian legal system currently exempts the internet provider from liability for posts made by third parties, so that Instagram cannot be held responsible for damages resulting from oversharing.
