O presente trabalho tem como objetivo analisar o bem de família do fiador no que tange
à sua penhorabilidade nos contratos de locação, à luz da doutrina, legislação vigente e
entendimento dos Tribunais, sobretudo, a partir da análise da decisão do RE 1.307.334 do STF,
que discutia a constitucionalidade da penhora de bem de família do fiador em contrato de
locação comercial, teve início em 12 de agosto de 2021. Naquele momento, o julgamento seguia
empatado, no qual, quatro ministros consideraram que não havia impedimento para a penhora,
enquanto outros quatro entendiam que a possibilidade violava o direito à moradia, ocasião em
foi suspenso o julgamento. Contudo, em sede de Repercussão Geral, o Supremo Tribunal
Federal, por 7 votos a 4, decidiu que locadores de imóveis comerciais podem penhorar bens de
família do fiador, para garantir o recebimento de valores, em caso de descumprimento
contratual pelo locatário. Analisaremos também toda a fundamentação que mostra ser possível
que o bem de família legal do fiador seja penhorado nos casos de obrigação decorrente de fiança
prestada em contratos de locação.
The present work aims to analyze the guarantor's family property with regard to its attachment in the lease contracts, in the light of doctrine, current legislation and the understanding of the Courts, above all, from the analysis of the decision of RE 1.307.334 of the STF, which discussed the constitutionality of the attachment of a commercial lease contract, began on August 12, 2021. At that time, the judgment was still tied, in which four ministers considered that there was no impediment to the attachment, while others understood that the possibility of violating the right to housing, occurred in was suspended as others determined. However, in the General Appeal, the Federal Supreme Court, by 7 votes to 4, ruled that commercial property lessors pledge family assets of the guarantor, to guarantee the receipt of values, in case of breach of contract by the lessee. We will also analyze all the reasoning that shows that it is possible that the legal property of the pawned in cases of obligation is due to a guarantee provided in lease contracts.
