O presente artigo visa analisar e debater questões e pontos controversos existentes na Lei 13.786, de 27 de dezembro de 2018, popularmente conhecida como Lei dos Distratos, que trouxe alterações significativas na Lei n.º 4591/1964 e Lei n.º e 6.766/1979, promulgada no intuito principal de resolver questões técnicas sobre o desfazimento dos contratos de promessa de venda e compra de imóveis adquiridos em regime de incorporação imobiliária e em parcelamento de solo urbano. Pretende-se neste estudo a compreensão e a tentativa de elaboração de prognóstico dos pontos considerados problemáticos, tentando visualizar, inclusive, através de entendimentos jurisprudenciais já fixados, qual será a posição manifestada pelos Tribunais futuramente.
This article aims to analyze and debate issues and controversial points existing in Law 13.786 of December 27, 2018, popularly known as the Distract Law, which brought significant changes in Law no. 4591/1964 and Law no. 6.766 / 1979, created to resolve technical issues regarding the termination of promissory contracts for sale and purchase of real estate acquired under real estate development and in installment of urban land. The aim of this study is to understand and try to elaborate prognosis of the points considered problematic, trying to visualize, even through established jurisprudential understandings, what will be the position expressed by the Courts in the future.
