Abstract
O presente trabalho apresentará os meios indutivos ao suicídio e à prática de automutilação de
crianças e adolescentes, num contexto contemporâneo (a “Era Informática”), e a
responsabilização penal de seus agentes. Aqui, estará em análise a criação, e disseminação, de
desafios ou jogos online, como a “Baleia-Azul” e a “Boneca Momo”, e sua relação com a nova
redação do artigo 122, do Código Penal, com as alterações trazidas pela Lei n. 13.968, de 26 de
dezembro de 2019. Outrossim, verá como o Direito, sobretudo, o Direito Penal, é responsável
pela prevenção, e combate, à Criminalidade Cibernética. No mais, abordará as medidas
aplicáveis aos agentes (ou autores) do tipo penal em questão, sendo eles imputáveis ou
inimputáveis, pela menoridade, em atenção aos critérios estabelecidos pelo Código Penal e pelo
Estatuto da Criança e do Adolescente.
This undergraduate thesis will present the means inducing suicide and the practice of self mutilation of children and adolescents, in a contemporary context (the “Informatics Age”), and the criminal liability of its agents. Here, the creation and dissemination of challenges or online games will be analyzed, such as “Blue Whale” and “Momo Doll”, and their relationship with the new wording of article 122, of the Penal Code, with the changes brought by Law n. 13,968, of December 26, 2019. Furthermore, you will see how Law, especially Criminal Law, is responsible for preventing and combating Cybercrime. Furthermore, it will address the measures applicable to agents (or perpetrators) of the criminal type in question, whether they are imputable or non-imputable, due to their minority, in compliance with the criteria established by the Penal Code and the Statute of Children and Adolescents.
