| dc.description.abstract | O presente estudo tem como objetivo avaliar a pertinência e a extensão de uma regulação específica sobre a inteligência artificial, considerando as transformações sociais provocadas por essa tecnologia, seus impactos éticos e morais, e os riscos a direitos fundamentais. Parte-se da hipótese de que a regulação pode atuar como um instrumento de ponderação, promovendo equilíbrio entre inovação tecnológica, proteção de direitos e desenvolvimento econômico. Para tanto, será adotado o método hipotético-dedutivo, confrontando teorias sobre regulação com os desafios impostos pela inteligência artificial e seus reflexos jurídicos, considerando a experiência acumulada a partir do desenvolvimento do direito cibernético. Serão analisados os principais modelos regulatórios existentes, identificando seus pontos fortes e limitações na governança dessa tecnologia emergente. Conclui-se que a regulação de novas tecnologias, especialmente da inteligência artificial, demanda uma abordagem flexível, evolutiva e multidimensional, combinando diferentes elementos e estratégias regulatórias nas esferas pública e privada, a fim de compatibilizar a inovação e o uso responsável da tecnologia. | |

| local.description.abstracten | The present study aims to evaluate the relevance and scope of specific regulation for artificial intelligence, considering the social transformations brought about by this technology, its ethical and moral impacts, and the risks to fundamental rights. It is hypothesized that regulation can act as a balancing instrument, promoting equilibrium between technological innovation, rights protection, and economic development. To this end, the hypothetical-deductive method will be adopted, comparing regulatory theories with the challenges posed by artificial intelligence and its legal implications, while taking into account the experience gained from the development of cyber law. The study will analyze the main existing regulatory models, identifying their strengths and limitations in governing this emerging technology. It concludes that regulating new technologies, especially artificial intelligence, requires a flexible, evolving, and multidimensional approach, combining different regulatory elements and strategies in both public and private spheres to reconcile innovation with the responsible use of technology. | |
