Diante do patente colapso dos sistemas processual penal e carcerário do Brasil, a
urgência pela atualização das legislações penais e a busca por alternativas que combatam a
morosidade e o engessamento do Poder Judiciário tornam-se cada vez mais urgentes.
Tendo em vista o cenário de incentivo às formas alternativas de solução de conflitos,
não só no sistema processual penal, mas no ordenamento jurídico pátrio como um todo, e seus
impactos na celeridade e economia de recursos monetários e humanos, vê-se como
fundamental o estudo de metodologias e instrumentos para a resolução consensual dos casos
criminais.
Com o advento da Lei nº 9.099 de 1995, e a introdução da transação penal e da
suspensão condicional do processo ao ordenamento jurídico penal brasileiro, a esfera jurídica
criminal caminhou em direção ao que se denomina de justiça penal consensual ou negociada.
A partir dessa ideia de negociação, novas formas alternativas de solução de conflitos
criminais surgiram, como a colaboração premiada e as Resoluções 181 de 2017 e 183 de 2018
do Conselho Nacional do Ministério Público.
Nesse sentido, o presente trabalho se propõe a analisar os primeiros passos da justiça
penal negociada no Brasil, dando enfoque ao acordo de não persecução penal, introduzido ao
Código de Processo Penal pela Lei nº 13.946 de 2019, denominada Pacote Anticrime, como
forma de política criminal viável.
Para tanto, o trabalho abordará as experiências prévias do Brasil com a justiça penal
negociada, as discussões acerca da viabilidade do acordo de não persecução penal antes de
sua introdução ao Código de Processo Penal, a aplicação do Acordo no ordenamento jurídico
brasileiro, e comparações com acordos internacionais penais.
Faced with the patent collapse of the criminal procedural and prisional systems in Brazil, the urgency for an update of the criminal laws and the search for alternatives that combats the slowness and cast of the Judiciary become increasingly urgent In view of the incentive scenario for alternative dispute resolutions, not only in the criminal procedural system, but in the national legal order as a whole, and its impacts on the speed and saving of monetary and human resources, it seems fundamental to study methodologies for the consensual resolution of criminal cases. With the advent of Law 9.099/95 and the introduction of penal transaction and conditional suspended sentence in the criminal procedure, the criminal legal order made its way to consensual or negotiated criminal justice. From this idea of negotiation new forms of alternative dispute resolution were created, such as the plea bargain and the Public Ministry National Council’s Resolutions 181/2017 and 183/2018. For that matter, the main objective of this monograph is to analyze the early stages of consensual or negotiated criminal justice in the brazilian criminal procedure, emphasizing the non prosecution agreement as a viable criminal policy, which was introduced at the Criminal Procedure Code by Law 13.946/19, known as “Anti-crime Bundle”. For this purpose, this monograph will cover other previous national experiences with consensual or negotiated criminal justice, as well as the discussion around the viability of the non prosecution agreement before its introduction at the Criminal Procedure Code, its implementation in the criminal legal order and in comparison with other international criminal agreements.
