Abstract
O presente trabalho visa analisar as medidas coercitivas atípicas que surgiram com o advento do
Código de Processo Civil de 2015, em seu artigo 139, IV, para tornar o processo executivo mais
eficaz, com maior adimplemento do quanto determinado nas decisões judiciais, e célere. Além
disso, objetiva-se analisar os limites impostos a estas medidas e a eficácia alcançada com sua
aplicação.
A lei processual autoriza o juiz a aplicar quaisquer meios sub-rogatórios, indutivos, coercitivos e
mandamentais para assegurar o cumprimento da ordem judicial proferida. No entanto, conforme
se verá, a redação flexível do referido dispositivo vem causando diversas discussões sobre sua
interpretação, aplicabilidade e constitucionalidade. Concluindo-se que a norma não vem sendo
aplicada como idealizou o legislador, o que poderia ser o motivo para sua eficácia insatisfatória.
This paper aims to analyze the atypical coercive measures established with the advent of the Civil Procedure Code of 2015, in its article 139, IV, in order to ensure a more effective executive process, with higher compliance with what is determined in court decisions. Furthermore, this paper aims to analyze the limits of these measures and the effectiveness achieved with their application. The mentioned procedural law authorizes the judge to apply any sub rogatory, inductive, coercive, and mandatory means to ensure compliance with the court order issued. However, as it will be analyzed, the way the article was wrote provides a flexible and open interpretation, which has been causing several discussions about its applicability, right interpretation, and constitutionality. Concluding that the norm has not been applied as the legislator idealized, which could be the reason for its unsatisfactory effectiveness.
