Abstract
Este artigo científico investiga a problemática da superlotação carcerária no
contexto brasileiro e sua relação direta com a violação dos direitos humanos dos
indivíduos encarcerados. Por meio de uma análise abrangente de dados estatísticos,
legislação nacional e internacional, bem como estudos de caso, busca-se
compreender os impactos dessa realidade sobre a dignidade e integridade dos
detentos. A superlotação carcerária é um fenômeno persistente no sistema prisional
brasileiro, causado por uma série de fatores complexos, incluindo políticas de
encarceramento massivo, deficiências estruturais das unidades prisionais e falhas no
sistema judiciário. Como resultado, os detentos enfrentam condições desumanas,
como falta de espaço adequado, acesso limitado a serviços básicos de saúde e
higiene precária. Além disso, a superlotação contribui para o aumento da violência,
da proliferação de doenças e da violação dos direitos fundamentais dos
encarcerados, contrariando os princípios estabelecidos pela Constituição Federal e
pelos tratados internacionais de direitos humanos dos quais o Brasil é signatário.
Portanto, este estudo visa contribuir para o debate sobre a superlotação
carcerária no Brasil, destacando a necessidade de uma abordagem humanitária e
baseada em direitos humanos para lidar com essa questão complexa e urgente.
This scientific article investigates the problem of prison overcrowding in the Brazilian context and its direct relationship with the violation of the human rights of incarcerated individuals. Through a comprehensive analysis of statistical data, national and international legislation, as well as case studies, the aim is to understand the impacts of this reality on the dignity and integrity of inmates. Prison overcrowding is a persistent phenomenon in the Brazilian prison system, caused by a series of complex factors, including mass incarceration policies, structural deficiencies in prison units and failures in the judicial system. As a result, inmates face inhumane conditions, such as lack of adequate space, limited access to basic health services and poor hygiene. Furthermore, overcrowding contributes to increased violence, the spread of disease and the violation of the fundamental rights of prisoners, contradicting the principles established by the Federal Constitution and international human rights treaties to which Brazil is a signatory. Therefore, this study aims to contribute to the debate on prison overcrowding in Brazil, highlighting the need for a humanitarian and human rights-based approach to address this complex and urgent issue.
