Resumo
O presente artigo tem como objetivo analisar a legislação brasileira acerca das assinaturas
eletrônicas, pontuando as características e diferenças principais entre os meios de assinatura,
principalmente no que concerne sua validade, conceituação e regulamentação no Brasil. As
referidas pontuações serão efetuadas através de exposições e comparações com a EU
Regulation Nº 910/2014, regulação da União Europeia que aborda o tema de maneira geral e é
aplicada em seus países membros. No Brasil, existem duas principais normas que versam sobre
os temas, a Medida Provisória Nº 2.200-2 de 2002 que institui a Infraestrutura de Chaves
Públicas Brasileira - ICP-Brasil e a Lei Nº 14.063 de 2020 que dispõe sobre o uso de assinaturas
eletrônicas em interações com entes públicos, e em questões de saúde. A relevância do tema
reside no aumento do uso de assinaturas eletrônicas e digitais, principalmente em um cenário
pós-pandemia onde as ferramentas se tornam parte do cotidiano substituindo as assinaturas
físicas. Dessa forma, cabe a comparação da complexidade apresentada pela regulação europeia,
que diverge dos normativos brasileiros sobre o tema, o que leva a conclusão da existência de
lacunas do direito que demandam urgente solução.
This article aims to analyze the Brazilian legislation on electronic signatures, pointing out the main characteristics and differences between the existing ways of this type of signature, mainly regarding their validity, conceptualization, and regulation in Brazil. These points will be carried out through exposures and comparisons with Regulation Nº. 910/2014, a European Union regulation that addresses the subject in general and is applied in its member states. In Brazil, there are two main legislations that deal with these subjects, the Provisional Measure No. 2,200- 2 of 2002, which establishes the Brazilian Public Key Infrastructure - ICP-Brasil, and Law No. 14,063 of 2020, which provides for the use of electronic signatures in interactions with public entities, and on health matters. The relevance of the topic lies in the increased use of electronic and digital signatures, especially in a post-pandemic scenario where these tools become part of the everyday life, replacing physical signatures. This way, it is worth comparing the complexity presented by the European regulation, which differs from Brazilian regulations, which leads to the conclusion that there are gaps in our law that demand an urgent solution.
