Abstract
O presente trabalho possui como objetivo analisar as alterações implantadas pela
Lei nº 13.467/2017, conhecida no jargão popular como “Reforma Trabalhista”, especialmente
no que concerne ao benefício da justiça gratuita e em seus reflexos no direito ao acesso à
Justiça. O benefício da justiça gratuita, no âmbito do processo do trabalho, sempre foi a forma
mais genuína de possibilitar a um trabalhador hipossuficiente, que teve seus direitos lesados, a
efetividade do direito constitucional ao acesso à Justiça. A problemática das alterações
promovidas reside em sua compatibilidade com a Constituição Federal e com os princípios
fundantes do Direito do Trabalho, que é um campo do direito que objetiva a correção da
desigualdade entre empregado e empregador.
The present project aims to analyze the changes implemented by Law 13.467/2017, known in popular jargon as “Labor Reform”, especially regarding to the benefit of free access to justice and its reflections on the right in question. The benefit of free justice in the context of the work process has always been the most genuine way of enabling a hypo-sufficient worker, who has had his rights harmed, the effectiveness of the constitutional right to access to justice. The problem of the changes promoted lies in their compatibility with the Federal Constitution and with the founding principles of labor law, which is a field of law that aims to correct the inequality between employee and employer.
