O presente artigo possui como tema central a prática da obsolescência programada, ou seja, a
redução artificial da vida útil de determinados produtos por seus fornecedores, e os seus
efeitos no âmbito jurídico. O enfoque da pesquisa foi elaborar um panorama sobre o
entendimento jurisprudencial brasileiro sobre o tema, abrangendo ainda o seu enquadramento
legal nas normas do Código de Defesa do Consumidor. Para a sua elaboração, foi realizada
uma pesquisa minuciosa em todos os tribunais do Brasil, utilizando como objeto de pesquisa
os termos “obsolescência programada”, afim de se obter a maior quantidade possíveis de
decisões sobre o tema. Encontrado um total de 19 acórdãos com os termos pesquisados, foi
possível analisar qual o posicionamento adotado por cada tribunal brasileiro, e por todos eles,
como uma perspectiva geral e, obter as conclusões ventiladas no decorrer do artigo não tão
somente quanto ao entendimento jurisprudencial do tema, mas também quanto à
obsolescência programada nas relações de consumo.
This article has as its central theme the practice of slowing down, that is, the artificial reduction of the useful life of certain products by their suppliers, and its effects in the legal scope. The focus of the research was to elaborate an overview of the Brazilian jurisprudential understanding on the subject, including its legal framework in the norms of the Consumer Protection Code. For its elaboration, a thorough research was carried out in all courts of Brazil, using as research object the terms “programmed obsolescence”, in order to obtain as many decisions as possible on the subject. Having found a total of 19 (nineteen) judgments with the terms searched, it was possible to analyze the position adopted by each Brazilian court, and all of them, as a general perspective, and was possible to obtain the conclusions drawn throughout the article not only as to the jurisprudential understanding of the but also about the slowing down practice in consumer relations.
