A revisão criminal, enquanto instituto jurídico, figura como uma poderosa ferramenta
de resgate da justiça diante das injustiças decorrentes da presunção de culpa. Contrapondo-se à
rigidez da coisa julgada, a revisão criminal se revela como uma ação de impugnação
independente, cuja essência transcende a mera natureza recursal, constituindo-se em um
extraordinário mecanismo de revisão judicial.
Sua pertinência encontra respaldo no ordenamento jurídico brasileiro, especialmente no Código
de Processo Penal, o qual estabelece os pressupostos para sua admissibilidade, neste contexto,
a revisão criminal emerge como um escudo de defesa da justiça, capaz de corrigir equívocos e
injustiças perpetradas pelos erros do sistema judicial. Ao possibilitar a reapreciação de casos
transitados em julgado, evidencia-se como um método indispensável para a efetivação dos
preceitos constitucionais e a restauração da dignidade e dos direitos daqueles injustamente
condenados.
Impulsionada pela necessidade de estabelecer um equilíbrio entre a segurança jurídica e as
demandas por equidade, a revisão criminal assume um papel central na busca pela efetivação
do Estado Democrático de Direito. A presente pesquisa, portanto, visa explorar em
profundidade a relevância e os procedimentos da revisão criminal como um dispositivo de
reparação das injustiças decorrentes da presunção de culpa, destacando sua aplicação na
jurisprudência brasileira e na promoção da equidade e justiça no âmbito do sistema penal
brasileiro.
Criminal review, as a legal institute, appears as a powerful tool for rescuing justice in the face of injustices arising from the presumption of guilt. Opposing the weakness of res judicata, criminal review reveals itself as an independent challenge action, whose essence transcends the mere appeal nature, constituting an extraordinary mechanism of judicial review. Its relevance finds support in the Brazilian legal system, especially in the Code of Criminal Procedure, which establishes the assumptions for its admissibility. In this context, criminal review emerges as a shield in defense of justice, capable of correcting mistakes and injustices perpetrated by the errors of the judicial system. By enabling the re-examination of final and unappealable cases, it is an indispensable method for implementing constitutional precepts and restoring the dignity and rights of those unjustly convicted. Driven by the need to establish a balance between legal security and demands for equity, criminal review assumes a central role in the search for the implementation of the Democratic Rule of Law. The present research, therefore, aims to explore in depth the relevance and procedures of criminal review as a spare parts device for injustices arising from the presumption of guilt, highlighting its application in Brazilian jurisdiction and in the promotion of equity and justice within the system.
