dc.description.abstractO presente artigo científico objetiva demonstrar a possibilidade da Agência Nacional de Saúde Suplementar, enquanto Agência reguladora, de combater a ineficiência estatal, desonerar o sistema Judiciário, proteger direitos indisponíveis e otimizar o acesso à justiça mediante a tomada de Termo de Ajustamento de Conduta em face de seguradoras e operadoras de planos de saúde que atuam em desacordo com a lei, com base na necessária implementação da administração de resultado e regulação consensual. Em resumo pretende-se comprovar a capacidade jurídica do TAC como mecanismo extrajudicial efetivo na tutela de interesses difusos, em especial do direito à saúde, tendo em vista o evidente escopo da Lei dos Planos de Saúde combinada com a Resolução Normativa n. 372 de 2015 de privilegiar a busca pelo resultado à incerta e morosa busca de solução pela via judicial.pt_BR
dc.description.abstractThis scientific article aims to demonstrate the possibility of the National Supplementary Health Agency, as a regulatory agency, to combat state inefficiency, exempt the Judiciary system, protect unavailable rights, and optimize the access to justice through the adoption of a Conduct Adjustment Commitment, against insurance companies and health plan operators who act violating the law, based on the necessary implementation of earnings management and consensual regulation. In summary, it is intended to prove the legal capacity of the TAC as an effective extrajudicial mechanism in the protection of diffuse interests, especially the right to health, before the evident scope of the Health Plans Law combined with the Normative Resolution n. 372 of 2015 to privilege the search for the result to the uncertain and time-consuming search for a solution through the judicial process.pt_BR
