A presente dissertação versa, em um panorama geral, acerca dos meios adequados de
solução de conflitos e o novo conceito de acesso à justiça, os quais passaram a ser
estimulados nos últimos anos. Mais especificamente, o trabalho trata do instituto do
Dispute Board em âmbito dos contratos de execução continuada, visando conceituá-lo
em uma visão doutrinária, bem como analisar suas características singulares. Além disso,
a dissertação objetiva examinar sua aplicação prática no Brasil, através dos regulamentos
de câmaras brasileiras e entendimentos formados, leis e projetos de leis. Por fim, é
também explorado o aspecto vinculante relativo aos Dispute Boards, mais
especificamente à luz de julgados do Superior Tribunal de Justiça, sendo abordado
acórdão paradigma sobre o assunto, e, com relação aos Tribunais locais, do entendimento
do Tribunal de Justiça de São Paulo sobre o tema.
The dissertation approaches, in an overview, the alternative dispute resolution methods as well as the new concept of Brazilian access to justice, which became to be stimulated in the last years. Specifically, the study focuses on the Dispute Board institute in a deferred execution contracts scope, aiming to conceptualize it in a doctrinal vision, along with the analysis of its particular characteristics. Besides that, the dissertation targets to exam the Dispute Board’s practical application in Brazil, throughout chambers’ rules and consolidated understandings, laws and law bills. Finally, it is also explored the biding effect relative to Dispute Boards, specially among the Brazilian case laws at the Superior Court of Justice, in which a leading case regarding the subject will be studied, and also at the São Paulo State Court of Appeals.
