Resumo
A corrupção é um fenômeno que ocorre desde que o mundo é mundo e é noticiado em
todos os países, seja nos mais desenvolvidos, onde há menores índices, seja nos menos
desenvolvimento, em que, comprovadamente, os índices de práticas corruptas são maiores.
O objetivo central do presente trabalho é abordar a corrupção empresarial, seus impactos
na sociedade, bem como demonstrar como um Programa de Integridade (ou de
Compliance) possui a capacidade de impedir a prática deste ato e diminuir a
responsabilidade das empresas perante a Administração Pública e eventuais processos
administrativos. Propõe-se assim apresentar reflexões e considerações sobre a corrupção na
atualidade, levando em consideração seu contexto no mundo e, especificamente, no Brasil,
concluindo com as medidas necessárias anticorrupção que devem ser adotadas pelas
empresas, maiores fomentadoras da economia e os atores principais no combate à
corrupção empresarial. Sob esta ótica, entende-se que a implementação de um Programa de
Compliance é considerado o mecanismo principal, sendo, inclusive, previsto no
ordenamento jurídico brasileiro, para a prevenção, detecção e reparação da corrupção.
Corruption is a phenomenon that occurs since the world has existed and is reported in all countries, whether in the more developed ones, where there are lower rates or in those less developed, where, demonstrably, the rates of corrupt practices are higher. The main objective of the present study is to discuss corporate corruption, its impacts on society, as well as to demonstrate how an Integrity Program (or Compliance Program) can prevent the practice of this act and to diminish the responsibility of the companies towards the Public Administration and eventual administrative suits. It is proposed to present reflections and considerations on corruption today, taking into consideration its context in the world and, specifically, in Brazil, concluding with the necessary anti-corruption measures that shall be adopted by the companies, major fomenters of the economy, and the main actors in the combat of corporate corruption. Under this view, it is understood that the implementation of a Compliance Program is considered the main mechanism and is even provided for in the Brazilian legal system, for the prevention, detection, and repair of corruption.
