Resumo
O presente trabalho objetiva esclarecer o instituto da legítima defesa na atuação
policial, e as implicações legais e sociais que o excesso dela oferece para o ordenamento
jurídico brasileiro. Por meio de pesquisa bibliográfica, com artigos científicos, doutrinas e
pesquisa em jurisprudências, foi estabelecida uma visão crítica e analítica sobre o tema e
assuntos propostos, como, os requisitos e espécies que caracterizam a legítima defesa, as
divisões teóricas elencadas em, excesso doloso, excesso culposo, excesso exculpante e
excesso acidental, além de breve análise sobre a atuação policial e como se aplica a legítima
defesa putativa do agente. Por fim, é abordada a distinção entre o estrito cumprimento do
dever legal e a legítima defesa e em como o excesso dessa legítima defesa policial afeta na
percepção da sociedade e consequentemente na confiança em agentes da segurança pública.
Assim, conclui-se sobre os efeitos negativos e puníveis do excesso da legítima defesa policial
na violência e ordem pública, apresentando propostas de melhoria para a melhor vivência em
sociedade.
This work aims to clarify the institute of self-defense in police action, and the legal and social implications that excessive self-defense has for the brazilian legal system. By means of bibliographical research, using scientific articles, doctrines and case law, a critical and analytical view was established on the theme and issues proposed, such as the requirements and species that characterize self-defense, the theoretical divisions listed in intentional excess, culpable excess, exculpatory excess and accidental excess, as well as to a brief analysis of police action and how the agent's putative self-defense is applied. Finally, the distinction between strict compliance with legal duty and self-defense is addressed, as well as how the excess of police self-defense affects society's perception of and consequently trust in public security agents. Thus, we conclude on the negative and punishable effects of excessive police self-defense on violence and public order, presenting improvement proposals for a better experience in society.
