dc.description.abstractO presente artigo tem como objetivo analisar os efeitos sucessórios do fenômeno juridicamente denominado multiparentalidade. A Constituição Federal de 1988 reconheceu inúmeras formas de entidades familiares, com preocupações voltadas para o desenvolvimento individual dos membros do núcleo familiar, valorizando, principalmente, o vínculo afetivo entre eles, em detrimento do caráter matrimonial e essencialmente patrimonial da família de outrora. Esse vínculo de afetividade foi utilizado na fundamentação do julgamento do Supremo Tribunal Federal ao julgar a repercussão geral - Tema 622, em que houve o reconhecimento jurídico da afetividade, do vínculo socioafetivo e biológico em igual grau de hierarquia jurídica e a possibilidade legal da multiparentalidade. Assim, este artigo busca demonstrar, por meio do raciocínio lógico jurídico, como ocorre a sucessão envolvendo membros de relações multiparentais, com base em pesquisas doutrinárias, jurisprudências e na legislação vigente.pt_BR
dc.description.abstractThis article aims to analyze the succession effects of the phenomenon legally called multiparenthood. The Federal Constitution of 1988 recognized numerous forms of family entities, with concerns focused on the individual development of the members of the family nucleus, valuing, especially, the affective bond between them, to the detriment of the matrimonial and essentially patrimonial character of the family of yore. This bond of affectivity was used in the reasoning of the judgment of the Federal Supreme Court when judging the general repercussion - Theme 622, in which there was the legal recognition of affectivity, the socio-affective and biological bond in an equal degree of legal hierarchy and the legal possibility of multiparenthood. Thus, this article seeks to demonstrate, through logical legal reasoning, how succession occurs involving members of multiparental relationships, based on doctrinal research, jurisprudence and on the current legislation.pt_BR
