Resumo
A escolha do presente tema ocorreu pela observação da discordância doutrinária e
jurisprudencial sobre o artigo 1.829 do Código Civil de 2002, o qual instituiu a concorrência
do cônjuge sobrevivo com os descendentes do cônjuge falecido na ordem de vocação
hereditária.
Os descendentes do de cujus e o cônjuge são herdeiros em linha reta e concorrem de
forma equalitária ou não, conforme o regime de bens adotado no casamento.
Diante de inúmeros debates jurisprudenciais e doutrinários sobre a incidência da
concorrência entre os herdeiros e cônjuge sobre bens particulares e comuns, além de
incertezas acerca das diferenças dos regimes de bens adotados pelo casal no casamento ou
equiparação dos entendimentos majoritários e minoritários na união estável.
Identificamos quatro correntes divergentes sobre o tema, além de entendimentos não
unânimes sobre o regime de separação total de bens, o qual é subdividido em separação
convencional e separação legal, divergências sobre o artigo 1.832 do Código Civil quanto à
quota parte do cônjuge e, ainda, debates acerca da sucessão híbrida, expressão sabiamente
criada por Giselda Hironaka, ao sabiamente observar a concorrência sobre os bens autor do
autor da herança.
Portanto, o presente trabalho traz a identificação de paradigma doutrinário e
jurisprudencial na sociedade brasileira e discorre sobre a possibilidade da concorrência
sucessória sobre os bens comuns, entendimento defendido por juristas como Maria Helena
Diniz, Guilherme Calmon Nogueira da Gama, Inácio de Carvalho Neto, frente ao
entendimento majoritário defendido por Flávio Tartuce, Giselda Hironaka, Mário Delgado,
entre outros, bem como seus efeitos no Direito das Sucessões.
The choice of the present theme occurred due to the observation of doctrinal and jurisprudential disagreement about article 1.829 of the Civil Code of 2002, which introduced competition between the deceased's spouse and the descendants of the deceased in the order of hereditary vocation. The descendants of the de cujus and the spouse are straight or first-class heirs and compete equally or not according to the property regime adopted in the marriage. Due to the numerous jurisprudential and doctrinal debates about the incidence of competition between the heirs and spouse over private and common property and uncertainties about the differences in property regimes adopted by the couple in the marriage or equating the majority and minority understandings in the stable union. We see, therefore, four divergent currents on the same theme, in addition to nonunanimous understandings on the regime of total separation of assets, which is subdivided into conventional separation and legal separation, disagreements about article 1,832 of the Civil Code regarding the share of the spouse and still debate about the hybrid succession, expression wisely created by Giselda Hironaka, when wisely observing the competition on the goods author of the inheritance. Therefore, the present work identifies the doctrinal and jurisprudential paradigm in Brazilian society, and brings an in-depth study on the possibility of succession over common goods, an understanding defended by Maria Helena Diniz, Guilherme Calmon Nogueira da Gama, Inácio de Carvalho Neto among others, in the face of the majority understanding defended by Flávio Tartuce, Giselda Hironaka, Mário Delgado etc. and its effects on Succession Law.
