O presente estudo tem como objetivo apresentar o conceito de Justiça Restaurativa, destacando
sua natureza fluida, a moldar pelo contexto sociocultural em que é aplicada, e seus aspectos
democráticos. Em segundo momento, demostra relação desses aspectos - fluidez e democracia,
ao explorar como essa mutabilidade contribui para um mais robusto caráter democrático da
Justiça Restaurativa. Para que se demostre esse o caráter multicultural da democratização,
descreve a evolução do estabelecimento e aplicação da Justiça Restaurativa no ordenamento
Brasileiro em comparação ao Belga, notório por seu desenvolvimento judiciário e legislativo
na área. Por fim, adota um método analítico-comparativo para demonstrar que, apesar de seu
aspecto fluído para atender sua aplicação multicultural, a Justiça Restaurativa mantém sua
essência democrática, que serve como um valor fundamental em sua emergência e
implementação.
The present study endeavors to elucidate the concept of Restorative Justice within a legal framework, emphasizing its inherent fluidity, subject to modulation by the socio-cultural context in which it is employed, as well as its democratic underpinnings. Subsequently, it delineates the interplay between these characteristics - fluidity and democracy - by probing how such adaptability fosters a more resilient democratic ethos within the sphere of Restorative Justice. To illustrate the multicultural facet of its democratization, the study traces the evolutionary trajectory of the establishment and application of Restorative Justice within the Brazilian legal system vis-à-vis the Belgian system, renowned for its advancements in both judicial and legislative spheres. Ultimately, employing an analytical-comparative approach, it seeks to demonstrate that, notwithstanding its adaptive nature to accommodate diverse cultural contexts, Restorative Justice retains its intrinsic democratic essence, serving as a cornerstone value in both its inception and implementation.
