O presente artigo traz como problema de pesquisa a criminalização da maconha no Brasil e a
associação do povo negro ao consumo e venda da planta. Para isso, foi apresentado o contexto
histórico da criminalização norte-americana, que desencadeou em uma Guerra às Drogas
altamente punitiva e midiática, essencial na criação de estereótipos sobre quem é o criminoso
de drogas. No Brasil, vê-se a criminalização da cannabis desde o período pós abolição, em
que a cultura e costumes do povo negro eram legalmente reprimidos. O texto, para maior
compreensão sobre as causas dessa associação, explica - por meio de revisão bibliográfica
sobre o histórico da criminalização das drogas e análises legislativas - como a construção de
um inimigo racial coletivo impacta no policiamento ostensivo e atuação policial em áreas
pobres e periféricas, criminalizando suas populações. Ademais, há ainda uma análise sobre a
Lei nº 11.343/2006, a Lei de Drogas, e seus desdobramentos, já que a ausência de critérios na
diferenciação entre usuário e traficante leva ao aumento da vigilância em determinadas áreas e
a prática de perfilamento racial pelos agentes de segurança, os quais são fatores contribuintes
para o superencarceramento, juntamente com a atuação do judiciário que, ainda hoje, perpetua
práticas de discriminação racial.
The present article brings as a research problem the criminalization of marijuana in Brazil and the association of black people with the consumption and sale of the plant. To this end, it was presented the historical context of North American criminalization, which triggered a highly punitive and media-driven War of Drugs, essential in the creation of stereotypes about who is the drug criminal. In Brazil, it is possible to see the criminalization of cannabis since the post-abolition period, in which the culture and customs of the black people were legally repressed. The article, for a greater understanding of the causes of this association, the text explains - through a bibliographic review on the history of drug criminalization and legislative analysis - how the construction of a collective racial enemy impacts on ostensive policing and police actions in poor and peripheral areas, criminalizing their populations. Moreover, there is an analysis of Law nº 11.343/2006, known as ”The Drug’s Law”, and its consequences, considering that the absence of criteria for differentiating between users and drug dealer leads to increased surveillance in certain areas and the practice of racial profiling by security agents, which are contributing factors to over-incarceration, concomitantly with the performance of the judiciary which, even today, perpetuates practices of racial discrimination.
